Important Dates
What is this lawsuit about?
The lawsuit alleges that Defendants violated California wage and hour laws, including claims for failure to properly pay minimum wages and overtime, failure to provide compliant meal and rest periods, failure to timely pay wages, failure to provide accurate wage statements, failure to reimburse business expenses, unfair competition, and related claims.
Defendants deny all allegations, deny that they violated any law, and contend that they complied with all applicable laws. The Settlement is a compromise of disputed claims and is not an admission of liability.
The Court authorized this Notice to inform you of the proposed Settlement and your rights before deciding whether to grant Final Approval.
What is a class action and what does the Settlement provide?
In a class action, one or more people sue on behalf of others with similar claims. Wise Auto Group and the other Defendants have agreed to pay $1,007,367.62 into a Gross Settlement Fund to resolve the lawsuit.
The Gross Settlement Fund will be used to pay:
- Individual Settlement Payments to participating Class Members
- Individual PAGA Payments to eligible Aggrieved Employees
- Attorneys’ fees and litigation costs, Settlement Administration Costs, and Class Representative Service Awards, subject to Court approval
- PAGA penalties, including the portion payable to the California Labor and Workforce Development Agency (LWDA)
- Taxes and other settlement-related amounts as described in the Settlement Agreement
If approved by the Court, the Net Settlement Amount will be distributed to participating Class Members based on their eligible workweeks during the applicable Class Period.
How do I know if I am part of the Class?
The Settlement Class consists of all current and former non-exempt employees who were employed by Defendants Anthony A. Batarse, Inc., Lloyd A. Wise Motors, Inc., and/or Vallejo Nissan, Inc., and paid on an hourly basis and/or on a commission basis, at any time from January 7, 2017 through July 30, 2025, and all current and former non-exempt employees who were employed by Defendant Wise Vision, Inc., and paid on an hourly basis and/or on a commission basis, at any time from November 17, 2019 through July 30, 2025.
You received the Notice because Defendants’ records indicate that you may be a Class Member.
Settlement Status
The Court authorized this Notice to inform you of the proposed Settlement and your rights before deciding whether to grant Final Approval.
The Final Approval Hearing is scheduled for August 11, 2026 at 9:00 a.m. in the Superior Court of California, County of Solano.
Settlement payments will be distributed only if the Court grants final approval and all applicable conditions are satisfied.
